Spain's Attorney General, the country's chief legal officer, has been compelled to step down after being convicted of disclosing classified details in a highly contentious case that has accentuated political divisions within the country.

Court Ruling and Penalties

The Supreme Court determined that the attorney general had illegally disclosed information about the tax situation of entrepreneur a prominent business figure, who is the boyfriend of a leading opposition figure.

The court handed down a 24-month prohibition from his position and a penalty of seven thousand two hundred euros. Furthermore, he must pay ten thousand euros to the businessman as restitution.

Political Consequences

The trial of García Ortiz fueled the already acrimonious relations between the left-wing government of the nation's leader and the right-wing opposition.

Divergent viewpoints were highlighted by responses to the guilty verdict.

"The prime minister must offer an apology to the Spanish people, resign and call elections, in that sequence," said Ester Muñoz for the main opposition party.

The administration stated it did not agree with the ruling but acknowledged it and would proceed with the appointment of a replacement prosecutor.

Judicial Dispute

Nevertheless, numerous politicians on the left expressed outrage at what they perceived as a decision influenced by politics.

Health Minister Mónica García, of the progressive coalition, stated the guilty verdict dealt a "lethal blow to presumption of innocence" and threw ordinary Spaniards under the bus when it came to the rule of law.

Origins of the Matter

The complex case dates back to March 2024, when the attorney general's office issued a press release indicating that the businessman had requested a plea bargain after being discovered avoiding tax payments worth €350,951.

The document corrected mistaken press reports stating that the prosecutor's department had initiated the settlement.

The source of the false information was the communications director of the conservative regional president of the capital region.

Court Case Details

The businessman filed a complaint against the chief prosecutor, claiming his confidentiality was violated. The case against García Ortiz also included allegations of disclosing details about the affair to the press.

Legal authorities highlighted the prosecutor's decision to replace his mobile device as suspicious.

Yet, there was no direct evidence connecting the attorney general to the disclosure and multiple reporters stated under oath during the proceedings that he had not provided information of their reporting.

Regarding the official communication, the attorney general stated he was merely rectifying the inaccurate information.

The attorney general can appeal against the ruling.

Broader Political Context

This comes as a severe blow for the national leader, who has been under judicial pressure on various fronts.

  • A family member is due to go on trial for alleged corruption
  • The prime minister's spouse is under investigation for her business activities
  • Two former senior figures in the Socialist Party are accused of managing a large-scale corruption operation
